Please be informed that on February 3, 2023, an amendment to the General provisions for the registration of individuals or legal entities that provide specialized services or execute specialized works (in accordance with the Federal Labor Law) was published on the Federal Official Gazette (the “Amendment”).
Please find herein some of the most relevant aspects of the Amendment:
– New requirements are added in order to obtain the Registry of Specialized Services Providers (“REPSE” for its Spanish acronym), which may increase the processing time for such registration.
– The Labor and Social Welfare Ministry (“STPS” for its Spanish acronym) may request information or documentation regarding the REPSE applicant, from the beneficiaries of the services provided or works executed by said applicant.
– Labor Inspectors may verify compliance with the obligations regarding subcontracting matters, of both the services providers and the beneficiaries thereof.
– The REPSE may be denied in case of non-compliance with the provisions regarding subcontracting matters or due to irregularities in connection with the employees or the specialized services agreements.
– The REPSE may be cancelled in case: (i) the documents submitted through the platform are different or inaccurate; (ii) false information or apocryphal documents are submitted; (iii) of non-compliance with the provisions regarding subcontracting matters; and (iv) of irregularities identified in connection with the employees or the specialized services agreements.
– Services providers may cancel the REPSE at any time, providing the STPS with the corresponding justification.
– Services providers may modify or update their activities in the REPSE, subject to certin requirements.
