Today (July 16, 2025), the decree amending the Federal Economic Competition Law (the “Competition Law”) approved by the Mexican Congress on June 30, 2025 (the “Amendments”), was published in the evening edition of the Federal Official Gazette.

Pursuant to its First Transitory Provision, the Amendments will enter into force the day after their publication (i.e., on July 17, 2025), whereas the Second Transitory Provision states that “While the Plenum of the National Antitrust Commission is integrated, COFECE will continue to perform its functions in accordance with the legal framework prior to the entry into force of this decree”.

These Transitory Provisions give rise to different interpretations as to when the substantive Amendments will enter into force.

Under a conservative interpretation, the Amendments will enter into force  on July 17, 2025, and the provisions prior to the Amendments will only continue to be applicable with respect to COFECE’s existence and functions until the CNA is created and replaces COFECE.

An alternative interpretation is that all the Amendments will only enter into force once the CNA is integrated.

Due to the room for interpretation and the potential consequences and considering that the transition is expected to occur within a limited timeframe, it is advisable to follow a conservative approach during this transition period.
