On Thursday, November 19, the Mexican Senate approved the proposal to regulate cannabis, which includes the Federal Law for the Regulation of Cannabis. This proposal must now be turned to the Chamber of Deputies for its revision, and approval, which must occur before December 15, 2020, in order to comply with the Supreme Court of Justice´s 2018 ruling.

Key Highlights:

  • The proposal approved by the Mexican Senate establishes rules for the sowing, transportation, production, warehousing and storage, distribution, consumption of cannabis, as well as specific regulations for hemp.
  • It includes the creation of the Mexican Institute for the Regulation and Control of Cannabis, an administrative unit of the Ministry of Health, which will grant authorizations in the form of licenses and permits, related to the growing, transformation, selling, research and import/export of cannabis.
  • Regarding the regulation of adult personal consumption of cannabis it sets forth the following: the possibility to carry up to 28 grams for personal consumption without sanction, the possibility of growing for personal consumption in private domiciles; it bans consumption of psychoactive cannabis in work related areas (public or private).
  • It is important to consider that this proposal must be turned to the Chamber of Deputies for revision and, should it be the case, final approval.
